Intermediate & Advanced Level Classes: Tuesdays 6:15-6:45 / Saturdays 11:00-11:30 --- Beginner & Introductory Level Classes: Tuesdays 6:45-7:15 / Saturdays 11:30-12:00

Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (“Agreement”) ​ In consideration of participating in Arctic Edge Ice Arena activities, I/we represent that I/we understand the nature of skating activities (“activity”) and that I/we are qualified, in good health and in proper physical condition to participate in such “activity”. I/we acknowledge that if I/we believe event conditions are unsafe, I/we will immediately discontinue participation in the “activity”. I/we fully understand this “activity” involves risks of serious bodily injury, including permanent disability, paralysis or even possible death, which may be caused by my/our own actions, or inactions, those of others participating in the “activity’, the condition in which the “activity” takes place, or the negligence of the “releases” named below; and that there may be others risks not known to me/us or not readily foreseeable at this time. I/we fully accept and assume all risks and all responsibility for losses, costs, and damages I/we incur as a result of my/our participation. I/we hereby release, discharge, and covenant not to sue Arctic Edge Ice Arena, Coaches, Staff, Employees, Volunteers, Participants or Parent(s) if another Participant is a minor and/or any unnamed individual associated with Arctic Edge Ice Arena and if applicable, owners and lessors of premises on which the “activity” takes place (each considered one of the “releasers” herein) from all liability, claims, demands, losses, or damages on my/our account caused or alleged to be caused in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations; and I/we further agree that if, despite this release, waiver of liability, and assumption of risk, I/we, or anyone on my/our behalf, makes a claim against any releases’, I/we will indemnify, save, and hold harmless each of the releases’ from any loss, liability, damage, or cost which any may incur as a result of such claim. Participant(s) hereby voluntarily acknowledges and assumes all risks related to COVID19. Participant(s) hereby waives, releases, covenants not to sue, discharges and agrees to indemnify, defend and hold harmless Owner and each of its affiliates, partners, members, managers, employees, representatives and agents. (“Owner Parties”) for, from and against any and all liability, claims, causes of action, damages, losses, cost, expense, illness, injuries and death (“Claims”) arising out of or related to COVID19 and/or access to or use of the Arctic Edge Ice Arena by Participant(s). Participant(s) acknowledges and agrees that this waiver, release and indemnification acknowledgement includes any Claims related to or arising from any actions or omissions (including the negligence of) Owner and/or the Owner parties. Arctic Edge Ice Arena Management, Employees and/or Contracted Employees have the right, but not the obligation, to provide rules, regulations and/or monitors for ice time. I/we hereby acknowledge that Arctic Edge Ice Arena shall not be responsible for the supervision of the skaters while at the skating location or other competition sites. I/we have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I/we have given up substantial rights by submitting this form and have submitted it freely and without any inducement or assurance of any nature and intend it to be a complete and conditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, not withstanding, shall continue in full force and effect. In the event that criminal, intentional, malicious or otherwise illegal or immoral actions occur, the entire waiver and release will be voided. This includes any physical/emotional/sexual misconduct, assault, battery, personal injury (whether physical or emotional), and/or damage to property due to intentional actions; this entire waiver and release will be immediately null and void.
